01Definitions

The following terms are used throughout this document:

• "Witthaya Labs", "we", "us", or "our" refers to Witthaya Labs, located at 271/4 Sukhumvit Soi 63, Khlong Tan Nuea, Watthana, Bangkok 10110, Thailand.
• "Service" refers to the online AI development courses, learning materials, mentoring sessions, and related resources provided by Witthaya Labs.
• "User", "you", or "your" refers to any individual who accesses, browses, or enrols in our Service.
• "Content" refers to course materials, videos, written guides, code samples, exercises, assessments, and any other material made available through our Service.
• "Agreement" refers to these Terms and Conditions, together with our Privacy Policy and Cookie Policy.

02Acceptance of Terms

By accessing our website or enrolling in any course, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use our Service.

• You must be at least 18 years of age to enrol independently. Learners under 18 may participate only with the involvement of a parent or legal guardian who agrees to these terms on their behalf.
• You confirm that you have the legal capacity to enter into this agreement.
• If you are accessing the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these terms.

03Service Description

Witthaya Labs provides online courses in AI development, delivered through a structured learning platform. Our current course offerings are:

• Getting Started with AI – An introductory course covering Python, data basics, and the ideas behind machine learning. Priced at ฿1,800.
• Machine Learning in Practice – A practical track for learners with some coding experience, involving hands-on model building and small-group feedback. Priced at ฿5,500.
• Guided Capstone and Portfolio – A mentor-supported programme culminating in a substantial AI project and portfolio piece. Priced at ฿9,600.

Course availability is subject to scheduled intake periods. We reserve the right to update, adjust, or withdraw courses with reasonable prior notice to enrolled learners.

04User Accounts

Access to course materials may require you to create a learner account. When doing so:

• You are responsible for keeping your login credentials secure and confidential.
• You agree not to share your account with others or allow others to access course materials through your login.
• You must notify us promptly if you suspect unauthorised use of your account.
• We reserve the right to suspend or close accounts that are found to be in breach of these terms.

05User Responsibilities

We ask that all learners engage with the Service in a considerate and honest manner. In particular, you agree not to:

• Copy, reproduce, or distribute course materials without our written permission.
• Submit work that is not your own or misrepresent your participation in exercises or assessments.
• Disrupt or interfere with the learning experience of other participants in group sessions.
• Use the Service for any unlawful purpose or in a way that could harm others.
• Attempt to access parts of the platform you are not authorised to use.
• Upload or transmit harmful, defamatory, or offensive content in any discussion or feedback space.

06Intellectual Property

All course content, materials, branding, and platform design are the intellectual property of Witthaya Labs or its licensors. We grant you a limited, personal, non-transferable licence to access and use course materials solely for your own educational purposes during your enrolment period.

This licence does not permit you to:

• Redistribute, resell, or sub-licence any course materials.
• Use our materials to create competing courses or educational products.
• Remove or alter any copyright or proprietary notices from materials.

Any original work you produce as part of a course exercise or capstone project remains your own. By sharing work within the platform, you grant us a limited licence to display it for internal educational feedback purposes only.

07Payment Terms

Course fees are displayed in Thai Baht (฿) and are due at the time of enrolment unless otherwise agreed in writing.

• Payment methods accepted are confirmed at checkout.
• All fees include applicable taxes where required by Thai law.
• Where a learner withdraws before accessing course materials, a full refund may be requested within 7 days of payment.
• Once course materials have been accessed, refunds are considered on a case-by-case basis at our discretion. Please contact us to discuss your situation.
• We do not offer automatic transfers of enrolment from one course to another; please contact us if your circumstances change.

08Course-Specific Terms

Enrolment

Enrolment is confirmed upon receipt of payment and a confirmation message from us. Intake periods and start dates are communicated at the time of enrolment.

Completion

Completion of a course is recognised when all required activities have been submitted and reviewed by your assigned mentor. Completion timelines vary by course and are provided in the course guide.

Mentoring Sessions

Mentoring sessions are scheduled by mutual agreement. If you need to reschedule, please give at least 24 hours' notice where possible. Missed sessions without notice may not be replaced.

Academic Integrity

We ask that all work submitted reflects your own effort. Sharing solutions with learners outside of group sessions, or submitting AI-generated code as your own without disclosure, is not in the spirit of the programme.

09Disclaimers

Witthaya Labs provides its Service in good faith and with care, but we make no warranties, expressed or implied, beyond what is stated here. In particular:

• We do not promise any specific career outcome, employment result, or income change as a result of completing a course.
• Course content is provided for educational purposes. It does not constitute professional advice in any field.
• Whilst we work to keep materials current, the field of AI changes quickly and some content may not always reflect the very latest developments.
• We do not warrant that the platform will be available without interruption or entirely free of technical issues.

10Limitation of Liability

To the extent permitted by applicable Thai law, Witthaya Labs shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Service. Our total liability to you for any direct loss shall not exceed the amount you paid for the course in question.

Nothing in these terms limits liability for fraud, gross negligence, or death or personal injury caused by our own fault.

Events beyond our reasonable control — including infrastructure outages, natural events, or regulatory changes — may affect Service availability, and we will not be held liable for resulting disruptions where we have acted reasonably.

11Indemnification

You agree to indemnify and hold harmless Witthaya Labs, its staff, and its mentors from any claims, costs, or damages arising from your breach of these terms or your misuse of the Service or its materials.

12Termination

You may withdraw from a course at any time by contacting us. Refund eligibility is as described in Section 7.

We reserve the right to suspend or end your access to the Service if you breach these terms in a material way, after giving you a reasonable opportunity to remedy the breach where appropriate. Sections 6, 9, 10, and 11 survive termination of this Agreement.

13Dispute Resolution

These terms are governed by the laws of Thailand. Any disputes arising from this Agreement shall fall under the jurisdiction of the courts of Bangkok, Thailand.

Before initiating formal proceedings, we encourage you to contact us directly so we can try to resolve the matter informally. Most issues can be resolved with a straightforward conversation, and we are always glad to listen.

14General Provisions

• Entire Agreement: These terms, together with our Privacy Policy and Cookie Policy, form the complete agreement between you and Witthaya Labs.
• Severability: If any part of these terms is found to be unenforceable, the remaining parts continue in full force.
• Waiver: A failure by us to enforce any provision does not waive our right to do so in the future.
• Assignment: You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours in the context of a business restructure, with reasonable notice to you.
• Notices: Formal notices should be sent by email to [email protected] or by post to our registered address.

15Changes to Terms

We may update these terms from time to time to reflect changes in our service or applicable law. When we do, we will update the "Last Updated" date at the top of this page. For significant changes, we will notify enrolled learners by email. Continued use of the Service after the effective date of updated terms constitutes your acceptance of those changes.
